Former Finks bikie Tristan Allbeury jailed for ten years for abuse of ex-partner

A jealous former bikie who laughed as he forced his partner to drink a wine glass of urine amid a torrent of horrific abuse has been jailed for 10 years. Tristan Allbeury subjected the woman to what Judge Belinda Lonsdale labelled a “disturbing level of cruelty” designed to intimidate and humiliate the victim. WA’s District Court was told the 43-year-old had just served a seven-year jail term for series of violent offences, including the brutal abuse of a different partner, when he began physically attacking his then-girlfriend in June 2021. The sentencing comes in the midst of the 16 Days in WA campaign against gender-based violence. The judge said the former Finks bikie took a “perverse pleasure” in degrading his ex. She also said the fact he was prepared to offend against her in public was “particularly disturbing”. The court was told the pair met in 2017 while Allbeury was in jail and within months of his release he assaulted her. The first took place at the Bentley Plaza after the woman received a text message from a male friend prompting Allbeury, who was subject to GPS monitoring, to interrogate her. As they headed back to their car, the father-of-one threatened her, then grabbed her neck and told her he was going to “cave her head in”, the court heard. Once inside the car he then smashed her head into the dashboard and started yelling abuse at her before punching her in the nose. As the woman was crying, Allbeury pulled out a pocket knife and threatened to kill her and accused her of cheating on him as they drove home before pulling over and punching her again. The following day, while the pair were in her bedroom, Allbeury once again accused her of cheating then pulled out a knife and told her he would cut off her finger that had his name tattooed on it. Shortly after he urinated in her wine glass then began laughing before forcing her to drink it. He then threatened to kill her again. The court was told the woman went to police where she was taken to hospital for treatment. However, the violence did not stop. A week later, in the midst of an argument Allbeury tasered the woman three times in her ribs, legs and back. Later that day the pair stayed at a hotel in Rivervale where the ex-senior bikie threw her to the floor and whipped her three or four times with a black belt buckle on her face and back then stomped on her head twice. Two days later, while the woman was waiting in line at Centrelink, Allbeury screamed at her in front of others that she transfer her money to him. Police were called and he was arrested a short time later. But Allbeury was not done with harassing the woman. While in prison between July 17 and 28, 2021 he made several calls to her to try to get her to withdraw her complaints. He then also contacted a number of “associates” to get her to change her statement. The court was then told between July 11 and September 30 several of Allbeury’s colleagues asked the woman to call his lawyer to help her withdraw her complaint. He even recruited his own mother to convince the woman to recant, organising for her to pay her $2000 if she signed a statutory declaration form saying she no longer wished to proceed. The court was told the woman signed the document because Allbeury told her she would be killed if she didn’t. She also signed a form to withdraw her complaint. Eventually, Allbeury stood trial but the sentencing hearing was told he did everything he could to stop it from proceeding and deliberately sacked his lawyer to delay the matter. After he obtained new counsel, he refused to take part in the pre-recording of the woman’s evidence. This meant the woman had to give evidence on the day. He then pleaded guilty to seven charges after she gave evidence and after the State dropped seven other charges. Allbeury’s lawyer Simon Freitag SC, told the court he client was sorry for what he had put his ex through saying in his letter to the court he described his actions as “putrid, heartless and terrifying”. But State prosecutor Katrin Robinson rejected he had shown any real remorse and implored Judge Lonsdale to not make him eligible for parole. Judge Lonsdale said she was highly sceptical about Allbeury’s remorse and willingness to change but she said there was a glimmer and because of that she made him eligible for parole. But she said he represented an unacceptable risk to women he formed intimate relationships with and that he was of high risk of reoffending. She jailed him for 10 years, backdated his sentence to June 2021 and made him eligible for parole.
