Murder trial continues
A witness during day two of a Bunbury Supreme Court murder trial told the court one of the men accused of killing 23-year-old Jarrad Fitzpatrick told her he stabbed the man and that he ``shouldn’t have done it’’.
The 17-year-old female witness told the court Kenneth John Smith kept repeating to her ``I shouldn’t have done it, I can’t believe it’’.
She said he was shaking and crying when he stuttered to her, ``I stabbed him and I left him in his own blood.’’
Kenneth Smith and his father, Colin John Smith, are each facing one count of murdering Mr Fitzpatrick on November 28, 2009, in a jury trial before Supreme Court Justice Peter Blaxell.
The Smith matriarch, Tanya Louise Smith, is also facing a charge of manslaughter or a possible alternate charge of being an accessory after the fact.
The witness described how Kenneth Smith was angry after receiving a phone call from ex-girlfriend Renee Kipling in which she said Ms Kipling had threatened to come to Kenneth Smith’s home and kill his family.
The witness said she heard Kenneth, Colin and Tanya Smith leave their home and return about 20 minutes later.
A neighbour of Renee Kipling, in Morrissey Street, Nicola Demarte, told the court he was woken about midnight by a female voice shouting from a car in the street.
He said he heard a female voice yell, ``next time I come back, I’ll kill you’’.
Mr Demarte then said he saw two male figures run to a car and drive away without the headlights on.
He said he went to bed but was soon up again and went to Ms Kipling’s home and discovered a body lying on the ground.
He said he saw Ms Kipling lying over the body and crying.
